TERMS AND CONDITIONS FOR GUESTS AND OTHER OCCUPANTS FOR THE RENTAL SUITE
Rental Inclusions
The following items, appliances, and services are included in the rent: furnished accommodation, electricity, gas, water, cable TV, and Internet.
Occupancy Limits
The maximum occupancy is 8 people for a three-bedroom unit, 6 people for a two-bedroom unit, and 4 people for a one-bedroom unit. This includes adults and children. Special permission is required for extra people.
Checkout
Checkout time is at 11:00 am. If you prefer a later checkout, you must call us and we will do our best to accommodate your request. If we are not informed of a delay in departure, a penalty of $250 per hour for late checkout will be charged and will be deducted from your security deposit or from your credit card. Upon checkout, all doors and windows must be closed and locked, and A/C turned off. Leave the beach pass, parking sticker, parking pass, garage remote, gate remote, and unit and facility keys on the dining table inside the unit. Do not return any items to the front desk or to anyone other than our staff. Failing to return the mentioned items will result a fee of $200 per lost item.
Cancellations and Changes
There will be no refund on cancellations, unless the unit can be re-rented. There are no refunds on unused lodging.
No Smoking
Smoking is not allowed in the accommodation unless it has a balcony or a designated smoking area.
Noise and Eviction
No parties, loud music, or loud TV is allowed. Excessive noise complaints by neighbors will lead to an immediate eviction with no refund. Please be respectful and do not disturb other residents or hotel guests. Miami Beach has strict noise violation rules. Police can be called by the neighbors, and this will result in immediate eviction without any refund of your rental payment.
Damages and Injury
All furnishings in living room, bedrooms, and kitchen are the property of the accommodation provider. The Guest is responsible for damages and repairs to the home and property resulting to and during the time of their occupancy. If there is any damage made in the property (pool, plumbing, damage to furniture, etc.) while the Guest is in the premises, the Guest agrees to have the charges incurred for those damages to be charged to the credit card used for reservation.
The Guest agrees that the accommodation provider is not responsible for any injury to any person occurring on the property during the term of occupancy. All damages to the home or property must be reported to the landlord at the time of incident. The Guest will be responsible for obtaining their own insurances and will not hold the owner of property liable to any and all instances and occurrence of injury. Guests agree to hold harmless the landlord, owner, and their companies in the event of any liability that may occur while occupying property.
Repairs and Alternate Accommodations
Any issues with the house/apartment with regards to appliances, electrical, pool, or anything related to the maintenance of the house will be fixed within 24 hours. There will not be any compensation given to the client in this matter, as we will fix any issues related to the property. If it is beyond repair and the house or apartment is in an inhabitable condition, alternate accommodations will be arranged. This will be done only after 48 hours of complaint. If no alternate accommodation is available, the liability for compensation will not exceed a maximum of $500.
Failure to Vacate
Failure of the Guests to vacate the premises upon checkout time and date will result to a daily rental fee of $600.00 per day, unless a previous extension of stay has been agreed upon.
The Guest's Duties:
- Keep the suite clean and tidy at all times and to maintain the condition of the appliances, electrical equipment, and furniture.
- Take precautionary measures to prevent fire in the unit and/or flooding in the kitchen and bathrooms.
- Dispose the garbage and put it in marked bins for garbage or recycle at the time of checkout. Clients should not throw anything in the toilets except toilet paper. Tissues, paper napkins, etc. clog the toilets in the houses, resulting in pipe blockage and flooding in the house. All plumbing cost for flood or clogged toilets will be borne by the Guests.
Unit Visit
The accommodation provider has the right to enter the unit giving a verbal or a written 24-hour notice to the occupant.
Non-payment of Rent / Expiration of Contract
Upon non-payment of rent or after the expiry of the contract, the accommodation provider or their authorized agents have the right to evict the occupant(s) after a 24-hour notice. Police and higher authorities will be notified for guests' eviction and will result in the removal of all your personal belongings immediately. All keys and Fobs will be deactivated, codes will be change, and guests will not be allowed back in the suite or house. These suites are furnished suites and everything in the units is owned by Pelican Suites.
Administrative Fees and Surcharges
Rent payments made by Visa/MasterCard or American Express cards are subject to administration fees of 2.5% and 3.5%, respectively. Paypal payments are free of administrative fees/surcharges. Deposit refunds will also incur a Paypal fee or credit card service fee of approximately 2.5% to 3.5%.
Agreement Acceptance
Your rental deposit for the accommodation is a confirmation of acceptance of these conditions.
This contract is not extendable or renewable. New contracts must be signed for extensions.
